1. About These Terms

These Terms of Use are entered into between you (“you” or “your”), as User, and, on the other side, THE ARCHITECTURE WITHIN S.R.L., a Romanian company, with its registered office at Bucharest, 122 Mihai Bravu Road, Building D27, 1st Entrance, 2nd Floor, Apartment 6, 2nd District, Romania, registered with the Trade Registry under no. J2026052769003, having tax identification number 55529344 (“us”, “we”, or “The Architecture Within”), as the operator of the TAW.

Acceptance of Terms.By accessing our website and using our Services, you fully acknowledge that you have read, understood, and accepted to be bound by these terms and conditions, which shall form a legally binding agreement between you and The Architecture Within (“Terms”).

Additional Terms. When you decide to access, test or use specific features described or available on the Platform, you may be subject to specific additional terms and conditions that will be displayed in the corresponding section and must be accepted before accessing those features.

2. Who We Are and How to Contact Us

What Is TAW. TAW is a platform that digitises human interaction using classical pattern libraries to help Users understand the structural patterns underlying how they think, decide, relate to others and respond under pressure. The Platform is designed around the analysis and interpretation of such patterns and their interaction between Users, without providing medical, psychological or psychotherapeutic advice or services.

Should you have any queries regarding the Platform or our Services, please do not hesitate to contact us at admin@thearchitecturewithin.com.

3. Pre-Contractual Information

Eligibility. The Services are available only to persons who are at least 18 years of age and who have full legal capacity under the law applicable to them. The Platform is not intended for, and must not be used by, persons under 18 years of age.

Age Confirmation.By creating an account, you confirm that you are at least 18 years of age. TAW may apply reasonable measures to verify a User’s age, including requesting confirmation or, where proportionate, additional evidence, and may restrict access to some or all Platform Features until the User’s age is confirmed.

Consequences of a False Declaration of Age. Where TAW establishes, or has reasonable grounds to believe, that a User is under 18 years of age, TAW will restrict access to the account without delay, terminate the account and delete the associated information, subject to any information TAW is required to retain under Applicable Law. A person whose account has been terminated on this ground may not create a new account before reaching 18 years of age. A false declaration of age is a breach of these Terms.

Jurisdictional Restrictions. The Services provided by TAW may not be available in all jurisdictions. It is the sole responsibility of the User to ensure that accessing or using the Services is lawful under the laws applicable in their country of residence or nationality.

Steps to Conclude the Contract. The contract between you and TAW is concluded by electronic means, as follows: you access the Platform; you complete the account creation form or select a third-party sign-in option; you are given the opportunity to read these Terms; and you conclude the contract by expressly accepting these Terms and completing your registration. TAW then sends you an e-mail to verify that you are in control of the e-mail used for registration.

Identifying and Correcting Input Errors. Before you complete your registration, you can review and correct the information you have entered by returning to the relevant field of the form. After registration, you can review and correct your account information at any time in the dedicated account section.

Storage of the Contract. These Terms are made available in a form which allows you to store and reproduce them, and they remain permanently accessible on the Platform. TAW records the version of the Terms you accepted and the date of your acceptance, and will provide you with a copy on request.

Language of the Contract. These Terms are available in English and in Romanian, and you may conclude the contract in either language. Where you are a Consumer resident in Romania, the Romanian version prevails in the event of any discrepancy between the two versions. In all other cases, the English version prevails.

Codes of Conduct. TAW does not currently adhere to any code of conduct within the meaning of Applicable Law on electronic commerce. Where TAW adheres to such a code, it will be identified on the Platform, together with the means of consulting it by electronic means.

4. Account Creation and Management

Account Creation. In order to use the Services, the User must create a personal account. An account may be created by providing a valid email address and a password, or by using one of the third-party sign-in options described below, and by expressly accepting these Terms of Use. Following account creation, the User will be invited to set a display name; providing a display name at that stage is optional, and the User may decline or postpone doing so.

Following registration, the User will receive an email requesting confirmation of the email address used to create the account. Certain functionalities may remain unavailable until the email address has been verified.

Third-Party Sign-In. The User may also create or access an account using the sign-in services provided by Google or Apple.

Where the User chooses this option, the User authenticates directly through the relevant third-party provider and authorises that provider to make available to TAW the information necessary to create or identify the User’s account, such as the User’s email address and other account identification information made available by the provider. TAW does not receive or store the password used by the User for the relevant Google or Apple account.

The use of Google or Apple sign-in is also subject to the terms, conditions and privacy rules applicable to the relevant third-party service. TAW does not control the operation, availability or security of such authentication services and shall not be responsible for any restriction, suspension or unavailability attributable to the relevant third-party provider.

Where an account is created through a third-party sign-in service, the User remains responsible for maintaining access to the relevant third-party account and for complying with the conditions applicable to its use.

Personal Account. Each account is personal and may be used by one User only. A single email address may be associated with one account only.

The User is responsible for maintaining the confidentiality and security of their login credentials and for all activity carried out through their account. The User may not share, transfer, resell or otherwise permit any third party to access or use their account.

Free Access and Future Charges. At the date of these Terms, access to the Platform is provided free of charge. TAW may introduce paid access, subscriptions or charges for particular Platform Features in the future.

No payment obligation arises for you unless TAW has informed you in advance of the applicable price and conditions and you have expressly agreed to them in a separate step. Continued use of your account does not constitute agreement to a payment obligation, and TAW will not convert an existing free account into a paid account without your express agreement. Where you do not agree, you may continue to use any Platform Features which remain available free of charge, or delete your account.

The creation or use of an account while the Platform is available free of charge does not grant the User any right to continued, unlimited or free access to the Platform in the future.

Account Deletion. The User may delete their account at any time by using the Delete Account functionality available in the dedicated account section. Account deletion is permanent and results in the deletion of the account and associated information, subject to any information that TAW is required or permitted to retain under Applicable Law or the Privacy Policy.

Suspension or Termination of Access. TAW may restrict, suspend or terminate the User’s access to the Platform where the User:

  • breaches these Terms;
  • uses the Platform unlawfully, fraudulently or abusively;
  • infringes the rights of TAW or any third party;
  • compromises or attempts to compromise the security, integrity or operation of the Platform; or
  • engages in any conduct prohibited under these Terms.

Any such measure shall be without prejudice to any other rights or remedies available to TAW under these Terms or Applicable Law.

5. Platform Features

The Platform Features described in this Section are referred to elsewhere in these Terms by the names used below.

Home.The Home section provides a general overview of the Platform and its main functionalities, including access to the Assessment and the User’s Dashboard, and presents the principal elements of the structural architecture framework.

Assessment.The Assessment consists of a structured set of 96 questions covering the User’s baseline patterns and responses under stress. The Assessment maps the User’s responses across four structural axes and uses them to generate the User’s structural profile or “Architecture”, reflecting patterns in how the User thinks, decides, relates to others and responds under pressure. The results are based exclusively on the information and responses provided by the User.

The Assessment is based on TAW’s proprietary structural framework and is intended to identify and organise behavioural and cognitive patterns within that framework. It is not based on a clinically validated psychological instrument, standardised psychometric test or diagnostic methodology, and the resulting Architecture does not constitute a psychological, psychiatric, medical or clinical assessment or diagnosis.

The User acknowledges that the accuracy, relevance and usefulness of the resulting Architecture depend on the accuracy, completeness and consistency of the responses provided during the Assessment. TAW does not independently verify the truth or accuracy of such responses. Users are therefore encouraged to answer the Assessment questions genuinely and based on their own perception and experience.

Upon completion of the Assessment, the Platform may generate and display structural outputs including axis scores, a structural identity, stress-related patterns, drift classifications, drivers, narrative interpretations and other architecture-based information derived from the User’s responses. Such outputs constitute models and interpretations within TAW’s structural framework and should not be understood as definitive statements regarding the User’s identity, personality, capabilities, health, suitability or future behaviour.

Where the Platform allows the User to retake the Assessment, subsequent results may differ from previous results depending on the responses provided and the User’s circumstances at the relevant time. Any comparison, continuity analysis or identified change between assessments reflects differences within the data and framework used by the Platform and does not, in itself, constitute a clinical or professional assessment of a change in the User’s condition.

Dashboard. The Dashboard provides the User with an overview of their Architecture and activity on the Platform, including structural information, compatibility information, structural drift, recent Matches, sharing status and continuity between assessments.

Report.Following completion of the Assessment, the Platform generates an Architecture Report presenting the User’s structural identity, axis breakdown and narrative interpretation of their structural patterns.

Wall. The Wall allows Users to publish reflections, insights and milestones and, where available, attach selected elements from their Report. Users may choose whether a post is publicly visible or visible only to their Matches and may interact with posts made by other Users.

Connect. The Connect functionality allows Users to select the types of connections they wish to explore through the Platform, currently including Romance, Friendship and Business partnership, and to configure the corresponding Match Preferences.

Find Matches. The Find Matches functionality allows Users who have enabled the relevant sharing and discoverability settings to discover other Users based on structural compatibility and the applicable connection preferences. Match discovery and ranking may take into account structural fit and other information made available through the Platform.

Matches. The Matches section displays connections established between Users following mutual acceptance and allows the User to access their confirmed Matches and related compatibility information.

Requests. The Requests section allows Users to manage connection invitations sent to or received from other Users and to view their status.

Companion.The AI Companion is a free-text conversational functionality through which Users may engage in general conversations with the AI system, including in relation to their Architecture and other matters they choose to discuss. Responses are generated through Artificial Intelligence, using Third-Party AI Services, and are grounded in information derived from the User’s structural profile, Assessment results and other information made available to the Companion through the Platform. Depending on the User’s query, the Companion may address matters such as pressure patterns, blind spots, relationship style, drivers, conflict patterns or other aspects reflected in the User’s Architecture.

The User expressly acknowledges that all responses provided through the AI Companion constitute AI-generated content and are produced algorithmically rather than by a human professional. The Companion may generate responses that are incomplete, inaccurate, inappropriate, inconsistent or not fully applicable to the User’s particular circumstances. Users should therefore exercise their own judgment when reviewing or relying on any output generated through the Companion.

The AI Companion is intended to provide architecture-based reflections and interpretations within the scope of the Platform. It does not provide medical, psychological, psychotherapeutic, psychiatric or other professional advice, assessment, diagnosis or treatment, and its outputs must not be regarded as a substitute for advice or assistance from an appropriately qualified professional.

Not a Monitored or Emergency Service. Conversations with the Companion are not reviewed by a human being in real time, and the Companion is not an emergency, crisis or support service. If you are in distress, at risk of harm, or concerned about the safety of yourself or another person, you should contact the emergency services or an appropriate professional or support service directly. The manner in which Artificial Intelligence is used in connection with the Platform, including in situations of this kind, is described in the AI Transparency Notice.

The User is responsible for the content of any prompts, questions or information submitted through the Companion and must not use the functionality for any unlawful, abusive, fraudulent or otherwise prohibited purpose. TAW may implement technical, usage or safety limitations in relation to the Companion, including limits on the number, frequency, length or volume of messages that may be submitted or generated within a given period. Such limits may differ between Users, may be modified from time to time and may apply temporarily or permanently where reasonably necessary for technical, operational, security or service-management purposes.

TAW does not guarantee that the Companion will be continuously available, that every question will receive a response, or that the same or similar questions will generate identical responses.

TAW may restrict, suspend, modify or discontinue access to the Companion, in whole or in part, where required for maintenance, security, compliance, safety, technical limitations or changes to the Third-Party AI Services or to any other underlying Artificial Intelligence services used by the Platform.

The User further acknowledges that certain information submitted to or generated through the Companion may be processed through the Third-Party AI Services and related third-party infrastructure in connection with the operation of the functionality, in accordance with the Privacy Policy and the applicable terms governing such processing.

Coaching.The Coaching functionality enables Users to record reflections and selected states over time and provides short reflective prompts and AI-generated insights based on the User’s structural profile and submitted reflections.

Messages. The Messages functionality enables Users who have established an accepted Match to communicate directly through the Platform. A conversation may be initiated once the relevant connection has been mutually accepted and may thereafter be accessed through the Messages section or the relevant Match. Users may exchange text messages and images through the Messages functionality. Messages and images exchanged through the Platform constitute content provided exclusively by the respective Users and are not communications issued, reviewed, approved or endorsed by TAW. Each User remains solely responsible for the content they send and for their interactions with other Users through the Platform.

Users must use the Messages functionality in a lawful, respectful and appropriate manner. It is strictly prohibited to use Messages to harass, intimidate, threaten, stalk, bully, insult, defame, discriminate against, exploit, manipulate, deceive, impersonate, pressure or otherwise abuse another User, or to engage in conduct that is hateful, coercive, fraudulent, unlawful, invasive of privacy or otherwise harmful. Users must not send spam, unsolicited advertising or promotional materials, repeated unwanted messages, malicious links, malware, phishing content, requests for passwords or other access credentials, or content intended to facilitate fraud, unlawful conduct or the circumvention of Platform safeguards.

Users must not send, request, solicit, transmit or otherwise share through Messages any image or other content of a sexual, pornographic, sexually explicit or sexually exploitative nature, including nudity or content depicting or implying sexual acts. Users must also refrain from sharing graphic, shocking or disturbing visual content, including images depicting death, dead bodies, severe injury, mutilation, significant blood or gore, violence or other material that may reasonably be expected to cause serious distress or emotional harm to another User. Content involving minors in any sexual, exploitative, abusive or otherwise inappropriate context is strictly prohibited.

Users must not use Messages to disclose, distribute or request confidential or private information concerning another person without a lawful basis or their consent, including intimate images, private correspondence, identification documents, financial information or other sensitive information. Users must also refrain from sending any content that infringes intellectual property rights, privacy rights, personality rights or any other rights of third parties.

A User may block another User through the functionalities made available on the Platform. Blocking prevents further interaction between the relevant Users through the functionalities to which the block applies. A User may also report another User or their conduct to TAW where the User reasonably considers that these Terms have been breached or that the relevant conduct is abusive, unlawful or otherwise inappropriate.

TAW may review reports and any information reasonably necessary to assess the reported conduct. Where TAW determines, in its discretion, that a User has breached these Terms, engaged in abusive or inappropriate conduct, created a risk for other Users or otherwise misused the Platform, TAW may take any measure it considers appropriate, including issuing a warning, restricting access to certain functionalities, suspending or permanently terminating the relevant account, without prejudice to any other rights or remedies available under these Terms or Applicable Law.

6. User Content, Reporting and Content Moderation

User Content.Certain Platform Features allow Users to create, upload, publish, transmit or otherwise make available content, including profile information, posts, reflections, messages, photographs, images, reactions and other materials (“User Content”). The User remains responsible for all User Content submitted or made available through their account.

Users must not submit, publish, transmit or otherwise make available User Content that is unlawful, fraudulent, deceptive, defamatory, threatening, harassing, hateful, discriminatory, abusive, sexually explicit, pornographic, exploitative, violent, graphic or otherwise harmful or inappropriate, or that infringes the privacy, intellectual property or other rights of any third party. The prohibitions and standards applicable to content exchanged through Messages shall apply, as relevant, to all User Content made available through any Platform Feature.

Reporting. Users and other persons may report User Content or conduct which they reasonably believe to be illegal, contrary to these Terms or otherwise inappropriate through the reporting mechanisms made available by TAW. Where required by the DSA or other Applicable Law, TAW shall provide mechanisms enabling notices concerning specific items of allegedly illegal content to be submitted electronically. Such notices should contain sufficient information to enable TAW to identify and assess the relevant content.

Content Moderation. TAW may review, restrict the visibility of, disable access to or remove User Content where TAW reasonably considers that such content violates these Terms, Applicable Law, the rights of another person or the safety or legitimate interests of Users or the Platform. Depending on the circumstances, TAW may also issue warnings, restrict access to particular Platform Features, suspend or terminate an account or take any other reasonable measure permitted under these Terms or Applicable Law.

TAW may use both automated and human means in connection with content moderation, where appropriate. The availability of moderation or reporting mechanisms does not imply that TAW monitors or reviews all User Content before or after it is made available through the Platform.

Information on Moderation Decisions. Where required by Applicable Law, including the DSA, TAW shall inform the affected User of a decision to remove, disable access to or otherwise restrict User Content, or to restrict, suspend or terminate access to the Platform on grounds relating to illegal content or incompatibility with these Terms, and shall provide the reasons for such decision in accordance with the applicable legal requirements.

No Obligation to Retain Prohibited Content. Nothing in these Terms shall require TAW to maintain, restore or continue to make available User Content that TAW is entitled or required to restrict or remove under Applicable Law or these Terms.

7. Nature of the Services

Structural Analysis Services.The Platform provides Users with tools designed to digitise human interaction through classical pattern libraries and to identify, organise and interpret structural and behavioural patterns based on the information provided by Users and on TAW’s proprietary framework. The Services are intended to help Users explore how they think, decide, relate to others and respond under pressure, and to understand how such patterns may interact with those of other Users.

Non-Clinical Nature. The Services are not clinical, medical, psychological, psychiatric or psychotherapeutic services. TAW does not provide psychological assessment, psychological testing, psychotherapy, counselling, psychiatric evaluation, medical evaluation, diagnosis, treatment, rehabilitation or any other service reserved to healthcare, mental-health or other regulated professionals. The Platform is designed as a technological tool for structural pattern analysis and interaction mapping and does not add medical, psychological or psychotherapeutic advice to the outputs generated through its framework.

No Psychological or Psychometric Assessment.The Assessment and the resulting Architecture are based on TAW’s proprietary structural framework. They are not based on a clinically validated psychological instrument, diagnostic framework or standardised psychometric test and are not intended to identify, confirm, exclude or classify any psychological, psychiatric, behavioural or medical condition. The outputs generated by the Platform represent structural models derived from self-reported information and must not be interpreted as an authoritative or definitive statement concerning a User’s personality, mental state, health, capabilities or condition.

No Diagnosis or Treatment. Nothing available through the Platform constitutes or is intended to constitute a diagnosis, screening, clinical evaluation, treatment plan, therapeutic intervention or recommendation regarding any physical or mental-health condition. The Platform does not determine whether a User suffers from, is at risk of, or should be treated for any medical, psychological, psychiatric or psychotherapeutic condition.

No Therapy or Counselling.The Platform does not provide therapy, psychotherapy, psychological counselling, psychiatric counselling, crisis counselling or any equivalent professional relationship. The use of terms such as reflection, coaching, guidance, patterns, pressure, stress, drivers, blind spots, structural strain or similar expressions within the Platform describes functionalities or structural concepts used within TAW’s framework and does not mean that TAW is providing regulated psychological, psychotherapeutic or medical services.

No Professional Advice. The Services and any content made available through them do not constitute medical, psychological, psychotherapeutic, psychiatric, legal, financial, investment, employment, relationship or other professional advice. Nothing available through the Platform should be understood as a recommendation that a User take, refrain from taking or modify any action where such decision would ordinarily require consideration by a suitably qualified professional.

General Wellbeing Suggestions.Certain Platform outputs may include general suggestions relating to matters such as rest, recovery, pacing, exercise, workload, routines, reflection or other everyday wellbeing practices. Any such suggestions are general in nature, are generated without taking into account the User’s complete medical history, physical condition, mental-health status, medication, treatment, contraindications or other individual health circumstances, and do not constitute medical, psychological, psychotherapeutic or other professional advice.

Such suggestions are not intended to diagnose, prevent, treat or manage any medical or psychological condition and should not be relied upon as a substitute for advice from an appropriately qualified professional. Where a User has any health condition, symptoms, treatment, limitation or other circumstance that may affect whether a particular activity or practice is appropriate, the User should seek appropriate professional advice before acting on such suggestion.

Professional Assistance.Where a matter requires medical, psychological, psychotherapeutic, psychiatric, legal, financial or other professional evaluation or assistance, the User should consult an appropriately qualified professional. The Platform must not be used as a substitute for such professional services or as the sole basis for decisions concerning the User’s health, safety, legal position, finances or other matters requiring specialised expertise.

No Professional Relationship. The use of the Platform, including the Assessment, Reports, Coaching, AI Companion, compatibility functionalities or any other Platform Feature, does not create a doctor-patient, psychologist-client, psychotherapist-client, counsellor-client, adviser-client or other professional relationship between TAW and the User.

Scope of TAW’s Role.TAW’s role is limited to providing the technological framework through which human interaction and structural patterns are digitised, collected, processed, organised, compared and displayed using classical pattern libraries, including through algorithmic and AI-assisted functionalities. TAW does not undertake to professionally evaluate the User or to validate the outputs of the Platform from a medical, psychological, psychotherapeutic or other professional perspective.

8. Platform Limitations and User Acknowledgements

Availability, Errors and Technical Limitations. TAW does not warrant that the Platform, any Platform Feature or any information, content or output made available through it will be continuously available, uninterrupted, secure, accurate, complete or error-free.

The Platform may be affected by maintenance, technical failures, software errors, connectivity issues, third-party service interruptions, provider outages, limitations or changes affecting Artificial Intelligence systems, cloud infrastructure or other technologies used in connection with the Platform, as well as other circumstances beyond TAW’s reasonable control.

TAW may also modify, update, restrict, suspend or discontinue any Platform Feature, in whole or in part, from time to time, subject to Applicable Law. Such changes may affect the availability, functionality or manner of operation of the relevant Platform Feature and may also result in differences between outputs generated at different times.

Nature of Platform Outputs.The User expressly acknowledges that the information, analyses, scores, classifications, narratives, compatibility results, prompts, AI-generated responses and other outputs made available through the Platform are generated within TAW’s structural framework and on the basis of the information available to the relevant functionality. Such outputs represent interpretations and models within that framework and should not be treated as objective, exhaustive or universally applicable statements concerning the User or any other person.

Assessment and Architecture Limitations. The Architecture generated following an Assessment depends directly on the responses provided by the User. TAW does not independently verify whether those responses are accurate, complete, consistent or representative of the User in every circumstance. Different responses, circumstances or subsequent Assessments may therefore produce different results.

AI-Generated Content.Certain content available through the Platform is generated using Artificial Intelligence, including through Third-Party AI Services. AI-generated outputs may contain errors, omissions, inaccuracies, inconsistencies, inappropriate formulations or information that is not applicable to the User’s particular circumstances.

TAW does not warrant that AI-generated content will be accurate, complete, current, consistent or suitable for any particular purpose. The same or substantially similar input may generate different outputs at different times, and the manner in which Artificial Intelligence systems generate an output may not always be predictable. The User is responsible for independently assessing any AI-generated content before relying or acting upon it.

Compatibility Scores and Matching.Compatibility scores, matching results, relationship intelligence reports and other interpersonal outputs are generated by comparing information available within the Platform’s structural framework. They represent only one structural perspective on the interaction between Users.

No compatibility score, Match, ranking, classification or other Platform output constitutes a representation or guarantee that two Users are compatible in practice or that any romantic, friendship, business or other relationship between them will be successful, appropriate, safe or beneficial. Conversely, a lower compatibility score does not mean that a relationship cannot be successful or appropriate.

User-Provided Information in Matching. Certain matching and discovery functionalities rely on information and preferences declared directly by Users, including information concerning themselves and the type of connection they seek. TAW does not independently verify such information and does not represent or warrant the identity, characteristics, intentions, background, suitability or authenticity of any User.

Filters, rankings, suggestions and Match results based on such information are provided exclusively to facilitate discovery between Users and must not be interpreted as verification, screening, approval or endorsement of another User by TAW.

Interactions between Users. TAW does not control the conduct of Users inside or outside the Platform and does not guarantee the behaviour, intentions, statements or actions of any User with whom another User communicates or meets.

Users remain solely responsible for deciding whether, how and to what extent they interact with another User and should exercise their own judgment and appropriate caution, particularly before sharing personal information, communicating outside the Platform, meeting another User in person, entering into a personal or business relationship or otherwise acting on information received from another User.

The existence of a Match or any other compatibility indication shall not be understood as a verification of identity, background check, safety assessment or recommendation by TAW.

Business Connections. Where the Platform enables Users to seek business partners, collaborators, co-founders or other professional connections, TAW acts solely as a technological means of facilitating discovery and communication between Users.

TAW does not investigate or verify the professional qualifications, financial standing, business experience, authority, reputation, resources or intentions of Users and does not participate in, arrange, negotiate, intermediate or guarantee any agreement, investment, financing or transaction that Users may independently decide to pursue. Any business-related information made available by a User, including any indication concerning a capital role, is self-declared. TAW does not process, hold or facilitate investment funds or other financial transactions through such functionality.

User-Generated Content. Posts, messages, photographs, profile information, reflections, reactions and any other content submitted or shared by Users represent content supplied by the relevant User and do not represent statements, opinions, recommendations or endorsements by TAW.

TAW may implement moderation, automated screening, reporting mechanisms and other protective measures, but does not warrant that all User Content will be reviewed before becoming available or that unlawful, inaccurate, offensive, inappropriate, misleading or otherwise objectionable content will always be detected or removed immediately. Users should exercise their own judgment when interacting with or relying upon content provided by other Users.

Messages and Private Communications. TAW does not adopt, endorse or verify statements, information, images or other content exchanged between Users through the Messages functionality. Except where review is undertaken in connection with a report, safety measure, legal requirement or other circumstance permitted under these Terms or Applicable Law, TAW does not undertake to routinely review private communications between Users.

Coaching, Reflections and Similar Outputs.Prompts, weekly insights, reflections and other outputs made available through Coaching or similar Platform Features are generated or organised by reference to the User’s Architecture and information supplied through the Platform. They are intended to provide prompts for personal reflection and may not accurately or fully reflect the User’s circumstances at any particular time.

No Guaranteed Outcome. TAW makes no representation or warranty that the use of the Platform or any Platform Feature will produce any particular personal, interpersonal, professional or other result.

In particular, TAW does not guarantee that use of the Platform will improve the User’s relationships, decision-making, behaviour, wellbeing, professional performance or understanding of themselves or others, nor that any action taken following a Platform output will achieve an expected result.

No Reliance on Platform Outputs as Sole Basis for Material Decisions. The User should not rely exclusively on an Assessment result, Architecture, compatibility score, AI-generated output, Match, coaching insight, User Content or other Platform output when making a decision that may materially affect their health, safety, relationships, finances, career, business or other significant interests.

The User remains responsible for considering any other information reasonably relevant to the decision and, where appropriate, obtaining independent information or assistance before acting.

User Responsibility. The User expressly acknowledges that the Platform is a tool intended to assist the User in exploring and understanding structural patterns and interactions and that the User retains responsibility for their own conclusions, choices, communications and actions.

The User shall exercise independent judgment when interpreting Platform outputs and when interacting with other Users and shall not represent to any third party that TAW has verified, guaranteed, recommended or endorsed any person, relationship, course of action, business opportunity or outcome.

9. Limitation of Liability

Liability Which Is Not Excluded or Limited. Nothing in these Terms excludes or limits the liability of TAW for:

  • death or injury to the physical or mental health of a User, caused by an act or omission of TAW;
  • fraud, wilful misconduct or gross negligence;
  • any other liability which cannot be excluded or limited under Applicable Law, including the mandatory rights of a Consumer.

The remaining provisions of this Section apply only to the extent that they do not affect the liability described above.

To the maximum extent permitted by Applicable Law and without prejudice to any rights or remedies that cannot lawfully be excluded or limited, TAW, its directors, employees, contractors and service providers shall not be liable for any loss, damage or adverse consequence arising from the User’s reliance on, interpretation of or actions taken on the basis of any Assessment result, Architecture, compatibility result, AI-generated content, coaching output, User Content or other information made available through the Platform.

In particular, subject to the limitations imposed by Applicable Law, TAW shall not be liable for any loss or damage arising from:

  • reliance on any Assessment result, Architecture, structural profile, axis score, narrative interpretation, structural drift, classification or other output generated through the Platform;
  • any inaccurate, incomplete, inconsistent or otherwise inappropriate AI-generated content, including content generated through the AI Companion or the Third-Party AI Services;
  • any decision, action or omission of the User based wholly or partly on information, suggestions, interpretations or outputs made available through the Platform;
  • any romantic, friendship, business, professional or other relationship entered into, continued, modified or terminated following a Match, compatibility score, relationship intelligence output or other interaction facilitated through the Platform;
  • the identity, conduct, statements, intentions, qualifications, background or actions of another User, whether occurring through the Platform or outside the Platform;
  • communications, photographs, posts, statements, information or other User Content created, transmitted or made available by another User;
  • emotional distress, disappointment, disagreement, conflict or other interpersonal consequences arising from communications or interactions between Users;
  • any business, professional, commercial or financial decision, negotiation, arrangement or transaction undertaken between Users who have connected through the Platform;
  • inaccurate, incomplete, misleading or outdated information, responses, preferences or other data provided by a User and used by the Platform to generate profiles, Matches, compatibility results or other outputs;
  • the User’s failure to independently assess information made available through the Platform or to exercise appropriate judgment and caution when interacting with another User;
  • the unavailability, malfunction, modification, suspension or discontinuation of any Third-Party AI Services or any other third-party technology, service, infrastructure or provider used in connection with the Platform;
  • errors, omissions, delays, interruptions, technical failures, connectivity issues, loss of functionality or temporary or permanent unavailability of the Platform or any Platform Feature; or
  • any modification, update or change to the Platform, its algorithms, structural framework, Artificial Intelligence systems or Platform Features that results in different outputs or functionality.

TAW does not warrant or assume responsibility for any particular personal, interpersonal, professional, business or other outcome resulting from the use of the Platform. The User remains solely responsible for their decisions, communications, relationships and interactions with other Users.

Without prejudice to the provisions of this Section on liability which is not excluded or limited, where the liability of TAW towards a User is engaged, that liability extends only to loss which is a direct and foreseeable consequence of the act or omission of TAW, and does not extend to indirect or consequential loss, loss of profit, loss of opportunity, loss of data or loss of reputation.

Where the liability of TAW towards a User is engaged and is not liability of a kind described in the provisions of this Section on liability which is not excluded or limited, the aggregate liability of TAW towards that User, in respect of all events occurring within any period of twelve consecutive months, is limited to the higher of (i) the total amount paid by the User to TAW during that period and (ii) EUR 250.

10. Technical Partners, Third-Party Providers and External Services

Certain Platform Features may depend on or interact with services, infrastructure, technologies, websites or platforms provided by third parties.

Where applicable, the User’s use of such third-party services may also be subject to the terms, policies and other rules of the relevant provider.

TAW does not control and is not responsible for the independent operation, availability, security, content, policies or performance of any third-party service or provider.

To the maximum extent permitted by Applicable Law, TAW shall not be liable for any loss, interruption, delay, error or other consequence arising from the unavailability, malfunction, modification or discontinuation of a third-party service used in connection with the Platform, or from the User’s use of or reliance on any third-party website, platform, product or service.

The integration or availability of a third-party service through the Platform does not, by itself, constitute an endorsement, recommendation or guarantee by TAW of that third party or its services.

11. Restrictions

During the use of the Platform and the Platform Features, the User represents and warrants that the User shall at all times:

12. Indemnification

Users Acting for Business Purposes. Where a User is not a Consumer, that User shall indemnify TAW against any claim brought against TAW by a third party, and against the damages, costs and reasonable legal fees which TAW is ordered to pay, or agrees to pay in settlement of such a claim, to the extent that the claim arises from:

  • User Content which that User made available through the Platform and which infringes the rights of a third party;
  • a breach of these Terms by that User; or
  • the unlawful or fraudulent use of the Platform by that User.

Consumers. If you are a Consumer, this Section does not apply to you. Your liability towards TAW is governed by the general rules of Applicable Law, and nothing in these Terms extends that liability beyond what those rules provide.

Conduct of the Claim.TAW will notify the User of any claim covered by this Section without undue delay, will give the User a reasonable opportunity to participate in the defence of the claim at the User’s own cost, and will not settle the claim without the prior written consent of the User, which the User may not unreasonably withhold or delay. TAW will take reasonable steps to mitigate the loss.

Limits of the Indemnity. The User is not liable under this Section for any loss which TAW could reasonably have avoided, for any part of a claim attributable to an act or omission of TAW, or for any fine or other administrative penalty imposed on TAW.

13. Intellectual Property Use

The User acknowledges that all intellectual property rights in and to the Platform and the Platform Features, including, without limitation, its software, source code, interface, design, structure, databases, text, graphics, visual elements, trademarks, logos, methodologies, frameworks, calculations, analytical models, assessment framework, structural architecture system, reports, analyses, charts, tables, presentations, AI-generated materials and any other content made available through the Platform, irrespective of their format or manner of presentation, are and shall remain the exclusive property of TAW or, where applicable, its licensors.

The User shall not acquire, by virtue of accessing or using the Platform or any Platform Feature, any right, title, licence or other interest in or to such intellectual property, except for the limited right to use the Platform in accordance with these Terms.

Without the prior written consent of TAW, the User may not copy, reproduce, record, download, modify, adapt, translate, distribute, publish, transmit, disclose, display, communicate to the public, make available, resell, sublicense, commercialise or otherwise exploit, in whole or in part, any content, material or element available through the Platform, including any reports, analyses, charts, graphics, screenshots, methodologies, frameworks, assessment materials, structural models or other proprietary content.

The User expressly acknowledges that the unauthorised mass distribution, systematic sharing, reproduction or republication of materials obtained from the Platform may cause significant commercial and financial harm to TAW, including by undermining the economic value and proprietary nature of such content. Any User who engages in such unauthorised distribution, sharing, reproduction or republication shall be liable, subject to Applicable Law, for the full amount of the damage caused to TAW as a result of such conduct, without prejudice to any other rights or remedies available to TAW under these Terms or Applicable Law.

Any materials or information submitted or uploaded by the User through the Platform remain the property of the User or of the relevant rights holder. To the extent necessary for the operation of the Platform and the provision of the Platform Features, the User grants TAW a limited, non-exclusive and royalty-free licence to use, reproduce, process, store, transmit and display such materials solely for those purposes.

The User may withdraw this licence at any time by deleting the relevant material or by deleting their account. Withdrawal takes effect for the future. It does not affect the use of material which has already been published or shared with other Users through the Platform, to the extent that such use can no longer reasonably be reversed, nor any use which TAW is required or permitted to make under Applicable Law.

This licence does not transfer ownership of the User’s materials and does not confer upon TAW any rights beyond those strictly necessary to operate the Platform and provide the Platform Features in accordance with these Terms.

14. We May Make Changes to Our Terms

We may change these Terms where there is a valid reason to do so. The valid reasons are:

  • a change in Applicable Law, or in the requirements of a competent public authority;
  • a decision of a court or of a competent public authority which affects the Platform or these Terms;
  • a change to the Platform Features, or the introduction of a new Platform Feature, which requires a corresponding change to these Terms;
  • a change to the technologies, service providers or security measures used to operate the Platform;
  • the correction of an error, ambiguity or inconsistency in these Terms; or
  • a change in the organisation of our business, provided the change does not reduce your rights under these Terms.

We will notify you of any change by email, at the address associated with your account, and by publishing the amended Terms on the Platform, at least 30 days before the change takes effect. The notice will identify the change, the reason for it and the date on which it takes effect.

If you do not agree to the change, you may terminate this contract free of charge at any time before the change takes effect, by deleting your account. If you continue to use the Platform after that date, the amended Terms apply to your subsequent use. Changes do not apply retroactively to your use of the Platform before the date on which they take effect.

Where a change is required in order to comply with Applicable Law and the applicable deadline does not allow 30 days’ notice, we will notify you as soon as possible and the change takes effect on the date required by law. Your right to terminate this contract free of charge is not affected.

15. We May Transfer This Agreement to Someone Else

You may not transfer your rights or obligations under these Terms, or your account, to any other person.

We may transfer our rights and obligations under these Terms to another company, in connection with a reorganisation, a merger or a transfer of all or part of our business, provided that the transfer does not reduce your rights under these Terms or under Applicable Law. We will notify you before the transfer takes effect. If you do not agree, you may terminate this contract free of charge by deleting your account at any time before the transfer takes effect.

16. How to Complain

If you are dissatisfied with the Platform, with a Platform Feature, or with a decision taken by TAW in relation to your account or your User Content, you may submit a complaint to admin@thearchitecturewithin.com. Please describe the matter and, where relevant, identify the account, the content or the decision concerned.

We will acknowledge receipt of your complaint without undue delay and will respond within 30 days of receiving it. Where the matter requires more time, we will tell you why and when you can expect a response.

If you are a Consumer and you are not satisfied with our response, you may refer the matter to the National Authority for Consumer Protection (Autoritatea Națională pentru Protecția Consumatorilor – ANPC, www.anpc.ro), or to an alternative dispute resolution entity competent under Romanian law on the alternative resolution of consumer disputes. Recourse to alternative dispute resolution does not affect your right to bring proceedings before the courts.

17. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or in connection with the Platform or the Platform Features, are governed by Romanian law.

If you are a Consumer, this choice of law does not deprive you of the protection afforded to you by provisions which cannot be derogated from by agreement under the law of the country in which you have your habitual residence.

If you are a Consumer, you may bring proceedings against TAW before the competent courts of Romania or before the courts of the country in which you are domiciled, and TAW may bring proceedings against you only before the courts of the country in which you are domiciled. In all other cases, the competent courts of Bucharest, Romania have exclusive jurisdiction.

18. General Provisions

Duration. This contract is concluded for an indefinite period. It takes effect when you accept these Terms and ends when your account is deleted, whether by you or by TAW in accordance with these Terms.

Order of Precedence. Where TAW makes additional terms available for a specific Platform Feature, those additional terms apply to that Platform Feature in addition to these Terms and, in the event of a conflict, prevail in respect of that Platform Feature only. The Privacy Policy, the Cookie Policy and the AI Transparency Notice are informational documents; they do not form part of these Terms and do not limit your rights under Applicable Law.

Notices. We will send notices to you by email, at the address associated with your account, or by a notice displayed within your account, unless Applicable Law requires otherwise. You may send notices to us at admin@thearchitecturewithin.com. You are responsible for keeping the email address associated with your account up to date.

Survival. The provisions of these Terms concerning intellectual property, the licence granted to TAW in respect of User Content, the limitation of liability, and governing law and jurisdiction survive the termination of this contract, together with any other provision which by its nature is intended to survive.

Severability. If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions continue to apply. You and we, acting in good faith, will replace the invalid or unenforceable provision with a valid and enforceable provision which most closely reflects its economic and legal purpose.

Effect of These Terms. These Terms, together with any additional terms you have accepted, constitute the agreement between you and TAW in relation to the Platform, and replace any previous version of the Terms. This does not affect any right you have under Applicable Law in respect of information provided to you before you concluded the contract.
